1. Acceptance of Terms
By accessing or using this website or participating in any services offered by Mickey’s Surf School, you agree to be bound by these Terms and Conditions.
If you do not agree, do not use this website or our services.
2. Services Provided
Mickey’s Surf School provides, but is not limited to:
- Private surf lessons
- Semi-private surf lessons
- Group surf lessons
- Children’s surf lessons
- Family surf lessons
- Advanced surf lessons
- Stand-up paddle lessons
- Surfboard rentals
- Surf tours
All services are provided in an outdoor ocean environment and involve inherent risks.
3. Assumption of Risk
You acknowledge and agree that:
- Surfing and ocean activities are inherently dangerous
- Conditions may include strong currents, waves, marine life, weather changes, and physical exertion
- Injury, illness, property damage, or death may occur
Participation is entirely at your own risk.
4. Limitation of Liability
To the maximum extent permitted by law, Mickey’s Surf School and Micah Piedvache shall not be liable for any:
- Injury
- Loss
- Damage
- Delay
- Cancellation
- Personal property loss
- Emotional distress
This applies whether arising from negligence or otherwise.
5. Indemnification
You agree to indemnify and hold harmless Mickey’s Surf School and Micah Piedvache from any claims, damages, or expenses arising from:
- Your participation in services
- Your use of this website
- Violation of these terms
6. Booking Requests and Payments
- Booking requests are submitted via forms
- No online payment gateway is used
- Pricing, availability, and confirmation are handled directly
- We reserve the right to refuse service at our discretion
7. Cancellations and Changes
Weather, ocean conditions, or safety concerns may require:
- Rescheduling
- Modification
- Cancellation of services
Such decisions are final and made in the interest of safety.
8. Intellectual Property
All content on this site, including text, images, logos, and branding, is the property of Mickey’s Surf School unless otherwise stated.
Unauthorized use is prohibited.
9. Arbitration
Any dispute arising out of or related to these Terms or services shall be resolved by binding arbitration, not court litigation.
Arbitration shall take place in the State of Hawaii.
10. Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles.
